WASHINGTON

The Obama administration announced Wednesday that it has pulled its legal support for the federal Defense of Marriage Act, stating that the law fails to meet constitutional scrutiny standards and therefore the administration is under no obligation to defend it.

Attorney General Eric H. Holder Jr. said in a statement released Wednesday that President Obama has decided that his administration “will cease defense of Section 3,” which states that marriage is between one man and one woman.

“[T]he President has concluded that given a number of factors, including a documented history of discrimination, classifications based on sexual orientation should be subject to a more heightened standard of scrutiny,” Mr. Holder said. “The President has also concluded that Section 3 of DOMA, as applied to legally married same-sex couples, fails to meet that standard and is therefore unconstitutional. Given that conclusion, the President has instructed the Department not to defend the statute in such cases. I fully concur with the President’s determination.”

The decision effectively throws the defense of DOMA into the lap of Congress, which can instruct its own attorneys to defend federal laws. Mr. Holder said he had informed members of Congress of the decision so that “members who wish to defend the statute may pursue that option.” The Washington Times

Since when is Congress in charge of enforcing laws? That is the job of the executive branch. If the attorney general won’t enforce the laws Congress enacts, who will?

Is our citizenry that ignorant of our Constitution that it can swallow this nonsense? We know what Obama thinks of the Constitution, but we still harbor a glimmer of hope that there are those in this country that still understand our system of government. All of these officials swore to uphold the Constitution, but their sworn pledges obviously mean nothing. This disrespect to our system of laws is the same kind of behavior favored by regimes in Libya, Egypt, and Venezuela. With this kind of behavior would you really be shocked to see Obama someday declared Chancellor for Life? Where is the outrage in this country?

There has been harsh criticism of the administration over their handling of the incident. Serious charges have been leveled that the administration, by ignoring the Geneva Convention, has put the USA at risk. Three days after the bomber was captured he warned that there was more to follow. Charges of incompetence have been leveled against Director of Homeland Security who shortly after the failed bombing crowed, “The System Worked.”

Responding to these charges today Obama read this statement during his daily teleprompter briefing:

Our decision to try Abdul Farouk Mutallab in civilian courts was an admirable one. It was intended to show the international community that the US recognizes the rule of law and no longer will conduct “cowboy diplomacy” in handling man-made disasters.

While our intentions were admirable, we did not go far enough. Recent criticism of our actions have made us realize that the proper handling of internationals is best handled by INTERPOL. After all that is why the organization was created.  It was for just such a case as this one that on December 17th I gave INTERPOL diplomatic immunity to operate here in the US. Little did we know just how wise and timely this decision that would prove to be.

For this reason we are now turning Mutallab over to French authorities who are sending over their Chief Inspector who will handle the interrogation and investigation. We are hereby dropping all civilian charges against Mutallab and any subsequent legal action against Mutallab will be at the discretion of INTERPOL.

INTERPOL has extensive experience in handling these types of investigations. Make no mistake– our ceding jurisdiction of this affair to INTERPOL will substantially increase our standing in the world community and will prevent Al-Qaeda from using US involvement in this matter as a recruitment tool.

French authorities have sent the following video of their Chief Inspector who has considerable success dealing with explosives and attempted bombings. The NIP supports President Obama and feels confident that Chief Inspector Clouseau could do no worse than Eric Holder.

NEW YORK, NY: Yesterday several thousand protestors gathered in NYC to rally against Obama’s decision to try Khalid Sheikh Mohammed and four other 911 conspirators as civilians in federal court. The outrage shared among the participants fired up the crowd Saturday at Foley Square as they battled harsh weather conditions during the 2 hour rally. The NIP has previously written about the real objectives of this show trial, and condemns the trial’s violation of the Geneva Convention.

During the rally Actor Brian Dennehy read a statement from the parents of Wall Street Journal reporter Daniel Pearl, whose beheading by KSM was broadcast in 2002 on video for the world to witness:

“We, who witnessed the darkest side of hell, and have since spent every moment of our lives studying the anatomy of terror, we refuse to accept the strategy of normalization that Holder’s decision represents. Terror is a crime against society, and should not be tried in the same court as crimes against individuals or against a particular country.” 911NeverForget.us

EL MARCO reported that last Tuesday NYC Police Commissioner Ray Kelly revealed that city officials were not even consulted by Attorney General Eric Holder prior to the announcement:

“There was no consultation, no consultation with the police department. That decision was made. We were informed.”

"To Hell With Your Freedom" - NYC Jury Pool

EL MARCO makes a valid point in his photo essay at LookingAt TheLeft.com. He points out that extremists like those in his photo will comprise a component of the show trial’s jury pool.

Andy McCarthy addressed the rally in front of the courthouse where he led the successful prosecution of the first World Trade Center bombing in 1993. In the National Review he exposed the damage that the NYC show trials will wreak upon our national security:

This summer, I theorized that Attorney General Eric Holder — and his boss — had a hidden agenda in ordering a re-investigation of the CIA for six-year-old alleged interrogation excesses that had already been scrutinized by non-partisan DOJ prosecutors who had found no basis for prosecution. Today’s announcement that KSM and other top al-Qaeda terrorists will be transferred to Manhattan federal court for civilian trials neatly fits this hidden agenda. Nothing results in more disclosures of government intelligence than civilian trials. They are a banquet of information, not just at the discovery stage but in the trial process itself, where witnesses — intelligence sources — must expose themselves and their secrets. It must be obvious to anyone interested in US security that these trials will serve as an excellent recruiting tool for Al Qaeda. Charles Krauthammer points out the bizarre incentive that Obama is now offering terrorists to come to America and commit acts of violence upon American cititzens:

If Obama wanted to circumnavigate international law by granting civilian rights to enemy combatants he could have done so in any US court. Holding these show trials in New York, without consulting with New York City police and other officials, shows the disrespect Obama has for New Yorkers and his bitter contempt for the Bush administration. If yesterday’s rally is any indication he will find little sympathy for this kind of political grandstanding among the American public.
